Marty Jackley for Congress (“Campaign,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy describes how we collect, use, share, and protect personal information through https://martyjackley.com/ and related services, including our chat widget, SMS messaging programs, email communications, and online contribution forms (collectively, the “Services”).
By using the Services, you agree to the practices described in this Privacy Policy.
1. Information We Collect
1.1 Information You Provide Directly
We collect information you submit when you:
- Make a contribution: name, mailing address, email address, phone number, employer, occupation, payment card information, and the certifications required by federal law (U.S. citizenship or permanent residency status, personal funds, etc.).
- Sign up for email updates: name, email address, and ZIP code.
- Opt in to SMS messaging: mobile phone number, first name, and ZIP code.
- Use the chat widget: name, email address, phone number, and the content of your message.
- Volunteer or attend an event: name, contact information, availability, skills, and event-specific details.
- Request a yard sign or campaign materials: name, mailing address, phone number, and delivery preferences.
- Submit a comment or question: the content you provide.
1.2 Information We Collect Automatically
When you use the Services, we automatically collect certain information, including:
- IP address and approximate geographic location derived from it.
- Device type, operating system, and browser type.
- Pages viewed, links clicked, and time spent on the Services.
- Referring URL.
- Cookies and similar tracking technologies (see Section 6).
1.3 Information from Third Parties
We may receive information about you from:
- Voter files and public records (name, address, voting history, party registration, demographic data).
- Data enhancement vendors (updated contact information, modeling scores).
- Social media platforms (information you have made public or chosen to share with the Campaign).
- Other campaigns, political committees, or allied organizations, where permitted by law.
2. How We Use Information
We use information for campaign purposes, including to:
- Communicate with you about the Campaign, including policy positions, events, endorsements, and fundraising appeals.
- Process contributions and comply with federal campaign finance reporting requirements.
- Respond to your questions, comments, and requests.
- Recruit, coordinate, and communicate with volunteers.
- Organize and promote campaign events.
- Identify and contact likely supporters and voters.
- Conduct modeling, analytics, and polling to improve Campaign effectiveness.
- Detect, prevent, and respond to fraud, security incidents, and abuse of the Services.
- Comply with legal obligations and respond to lawful requests from government authorities.
3. How We Share Information
3.1 FEC Public Disclosure
Federal law requires the Campaign to publicly disclose the name, mailing address, occupation, and employer of any individual whose contributions to the Campaign aggregate more than $200 in an election cycle. This information is filed with the Federal Election Commission and becomes publicly available at www.fec.gov. We cannot prevent this disclosure.
3.2 Service Providers
We share information with vendors and service providers who perform services on our behalf, including:
- Payment processors (for contribution processing).
- Email service providers.
- SMS messaging vendors and 10DLC compliance platforms.
- Hosting, infrastructure, and security providers.
- CRM, voter file, and data analytics vendors.
- Event registration and management platforms.
- Chat widget providers.
- Legal, accounting, and compliance advisors.
These service providers are authorized to use personal information only as necessary to provide services to the Campaign.
3.3 Political Committees and Allied Organizations
Consistent with standard practice among political campaigns, we may exchange, rent, or share supporter, donor, and volunteer information (excluding mobile phone numbers enrolled in SMS programs and information subject to specific non-sharing commitments) with other candidates, political committees, and organizations whose goals we support. If you do not want your information shared in this way, you can opt out by contacting us at the address in Section 11.
3.4 Mobile Phone Numbers
We do not sell, rent, lease, or share mobile phone numbers collected through our SMS opt-in programs with third parties or affiliates for their marketing purposes. Mobile phone numbers are shared only with our SMS messaging vendors and compliance providers, solely to deliver messages and maintain regulatory compliance.
3.5 Legal Requirements
We may disclose information when required by law, subpoena, court order, or other legal process, or when we believe in good faith that disclosure is necessary to protect the rights, property, or safety of the Campaign, its supporters, or the public.
3.6 Business Transfers
If the Campaign winds down, merges, or transfers assets to a successor committee or related entity (such as a transition PAC or leadership committee), information may be transferred as part of that process, subject to applicable law.
4. SMS Messaging Privacy
Marty Jackley for Congress operates separate SMS messaging programs for supporter communications and for volunteer/event coordination. Each program has its own opt-in and its own opt-out.
- Opting in to one program does not opt you in to the other.
- Opting out of one program does not opt you out of the other. Reply STOP to the relevant program to opt out of that specific program.
- We do not share mobile phone numbers collected through opt-in with third parties for marketing.

5. Your Choices
- Email: You can unsubscribe from Campaign emails by clicking the unsubscribe link in any email or by contacting us at the address in Section 11.
- SMS: Reply STOP to any message in a specific SMS program to opt out of that program.
- Information sharing with other committees: Contact us to opt out of information sharing described in Section 3.3.
- Account and contact information: Contact us to request updates or corrections to your information.
Even if you opt out of marketing and fundraising communications, we may still send you transactional messages, such as receipts for contributions and responses to inquiries you have submitted.
6. Cookies and Tracking Technologies
The Services use cookies, pixels, web beacons, and similar technologies to:
- Remember your preferences.
- Analyze traffic and usage patterns.
- Measure the effectiveness of advertising and outreach.
- Deliver targeted advertising on third-party platforms (such as Meta, Google, and YouTube).
You can control cookies through your browser settings. Disabling cookies may affect your ability to use certain features of the Services.
Some browsers offer a “Do Not Track” signal. Because there is no consistent industry standard for responding to these signals, the Services currently do not respond to them.
7. Data Security
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

8. Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, to comply with legal obligations (including FEC recordkeeping requirements), to resolve disputes, and to enforce our agreements. Federal law requires campaigns to retain certain contribution records for at least three years.
9. Children
The Services are not directed to children under the age of 18. We do not knowingly collect personal information from children under 18. Federal law prohibits contributions from individuals under 18. If you believe a child has provided personal information through the Services, contact us and we will take appropriate steps to delete the information.
10. State-Specific Disclosures
California Residents
California residents may have rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including the right to know what personal information we collect, the right to request deletion, the right to correct inaccurate information, and the right to opt out of the “sale” or “sharing” of personal information. Note that political campaigns are subject to different treatment under California law than commercial businesses, and some rights may be limited or inapplicable. To exercise any available rights, contact us at the address in Section 11.
We do not sell personal information for monetary consideration.
Other State Privacy Laws
Residents of other states (including Colorado, Connecticut, Virginia, Utah, Texas, and others with comprehensive privacy laws) may have additional rights. Political campaigns are often exempt from these laws, but we will consider and respond to good-faith requests. Contact us at the address in Section 11.

12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The updated Privacy Policy will be posted on this page with a revised “Last Updated” date. Material changes will be communicated through the Services or by other reasonable means. Your continued use of the Services after the updated Privacy Policy is posted constitutes acceptance of the revised Privacy Policy.
