Welcome to the official website of Marty Jackley for Congress (“Campaign,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of https://martyjackley.com/ and any related services, including our chat widget, SMS messaging program, email communications, and online contribution forms (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

To use the Services, you must be at least 18 years of age or the age of majority in your jurisdiction, whichever is higher. By using the Services, you represent that you meet this requirement.

Additional eligibility requirements apply to contributions. See Section 5.

2. The Campaign

Marty Jackley for Congress is the principal campaign committee of Marty Jackley, a candidate for the United States House of Representatives from South Dakota. The Campaign is registered with the Federal Election Commission (FEC) and complies with the Federal Election Campaign Act (FECA) and applicable regulations.

3. Permitted Use

You may use the Services for lawful purposes only. You agree not to:

  • Use the Services in violation of any applicable federal, state, or local law.
  • Attempt to gain unauthorized access to any portion of the Services, including our servers, databases, or accounts.
  • Interfere with, disrupt, or degrade the Services or the servers or networks connected to the Services.
  • Scrape, harvest, or collect information about other users, volunteers, donors, or staff.
  • Upload, submit, or transmit any content that is unlawful, defamatory, harassing, threatening, obscene, or infringing on the rights of others.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Use the Services to transmit any malware, virus, worm, or other malicious code.
  • Use automated systems (bots, spiders, crawlers) to access the Services without our prior written permission, except for public search engine indexing.

4. User-Submitted Content

The Services may allow you to submit comments, questions, messages, or other content (“User Content”). By submitting User Content, you grant the Campaign a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, distribute, and display that content in connection with campaign activities.

You represent and warrant that you own or have the necessary rights to the User Content you submit and that it does not violate the rights of any third party.

The Campaign reserves the right, but is not obligated, to review, edit, or remove any User Content.

5. Contributions

Contributions to Marty Jackley for Congress are subject to federal law and FEC regulations. By making a contribution, you certify that:

  • You are a United States citizen or a lawfully admitted permanent resident (green card holder).
  • The contribution is made from your own funds and not from the funds of any other person or entity.
  • The contribution is not made from the funds of a corporation, labor organization, federal government contractor, or foreign national.
  • You are at least 18 years of age.
  • The contribution is made on a personal credit or debit card for which you have the legal obligation to pay, and is not made on a corporate or business card.

Federal law requires that the Campaign report the name, address, occupation, and employer of any individual whose contributions aggregate more than $200 in an election cycle. This information is made public through FEC filings.

Federal contribution limits apply. Current limits are published at www.fec.gov.

Contributions are not tax deductible for federal income tax purposes.

6. SMS Messaging Program

Marty Jackley for Congress operates two separate SMS messaging programs: a supporter communications program and a volunteer/event coordination program. Consent to one program does not constitute consent to the other. Each program is opted into independently through its own checkbox or keyword opt-in.

Supporter Communications Program: By opting in, you consent to receive text messages from Marty Jackley for Congress including campaign updates, event announcements, fundraising appeals, endorsement news, and voter mobilization messages. Message frequency varies and may increase significantly as Election Day approaches.

Volunteer and Event Coordination Program: By opting in, you consent to receive text messages related to volunteer assignments, event logistics, responses to questions you have submitted through our chat widget, and follow-up communications related to inquiries you have made.

For both programs:

  • Message and data rates may apply. Check with your mobile carrier.
  • Reply STOP at any time to unsubscribe from that specific program.
  • Reply HELP for assistance, or contact us at info@martyjackley.com.
  • Consent to receive text messages is not a condition of contributing to, volunteering for, or otherwise supporting the Campaign.
  • We do not sell, rent, or share your mobile phone number with third parties for their marketing purposes. Phone numbers may be shared with our SMS service providers and compliance vendors solely to operate the programs.
  • Supported carriers include the major U.S. carriers. Carriers are not liable for delayed or undelivered messages.

If you replace, cancel, or forfeit your mobile number, please notify us so we can update our records.

7. Chat Widget

The chat widget on martyjackley.com allows you to submit questions, comments, or requests to the Campaign. Messages sent through the chat widget are logged and may be reviewed by Campaign staff, volunteers, or service providers. Do not use the chat widget to transmit sensitive personal information (such as Social Security numbers, financial account numbers, or passwords).

8. Intellectual Property

All content on the Services, including text, graphics, logos, images, audio, video, data compilations, and software, is the property of Marty Jackley for Congress or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

“Marty Jackley for Congress,” related logos, and other campaign marks are trademarks of the Campaign. You may not use these marks without prior written permission, except for factual news reporting, commentary, or other uses protected under the First Amendment or fair use doctrine.

Limited reproduction of content for personal, non-commercial use is permitted provided you retain all copyright and other proprietary notices.

9. Third-Party Links and Services

The Services may contain links to third-party websites and services, and may integrate with third-party platforms (including payment processors, email service providers, social media platforms, and SMS vendors). The Campaign does not control and is not responsible for the content, privacy practices, or terms of any third-party site or service. Your use of third-party sites and services is at your own risk and subject to the terms of those third parties.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. THE CAMPAIGN DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Information on the Services is provided for informational purposes only and does not constitute legal, financial, medical, or other professional advice.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE CAMPAIGN, ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF THE CAMPAIGN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Campaign, its officers, directors, employees, volunteers, agents, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

13. Changes to the Services and These Terms

The Campaign may modify or discontinue the Services at any time without notice. The Campaign may also revise these Terms from time to time. The updated Terms will be posted with a revised “Last Updated” date. Your continued use of the Services after the updated Terms are posted constitutes acceptance of the revised Terms.

14. Governing Law and Venue

These Terms are governed by the laws of the State of South Dakota, without regard to its conflict of laws principles, and applicable federal law. Any dispute arising out of or related to these Terms or the Services will be brought exclusively in the state or federal courts located in Pennington County, South Dakota, and you consent to the personal jurisdiction of those courts.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Campaign regarding the Services and supersede any prior agreements.
